Dolo eventual e culpa consciente: O posicionamento do Supremo Tribunal Federal frente aos limites das duas modalidades em casos de homicídio (2024)

  • Abstract: This work presents the dolus eventualis, conscious guilt and how the Federal Supreme Court interprets these two modalities, as well as which criteria are used to resolve problems that occur in factual reality. The two modalities are understood within the subjective sphere in the Theory of Crime and interpreted according to the subjective type. It can be seen that when intent ceases to be solely the desire to carry out the verb of the type and starts to also be considered as the assumption of the risk of carrying it out, a type of intent is created that has a close difference with another type of intente fault. Brazilian doctrine considers that the Brazilian Penal Code adopted the theory of consent, whereby dolus eventualis is defined as the assumption of risk plus the agent's indifference to the result, whereas conscious guilt is the prediction of the result with the belief that it does not occur. The challenge lies in interpreting the elements of practical cases and defining objective contours that help to say when there is one and when there is another. The main elements considered by the court are the facts prior to the action, the subsequent ones, the characteristics of the subject, as well as the degree of danger of the situation. Despite using the theory of consent as a pillar to differentiate between dolus eventualis and conscious guilt, the decisions mostly prioritize the cognitive element to the detriment of the volitional element, resulting in the definition of possible intent as just the assumption of risk. In the case of drunken traffic homicide, when the volitional element is analyzed, the result is conscious guilt. When only the cognitive aspect is taken into account, through the assumption of risk, drunkenness is seen as dolus eventualis
